What is Reckless Disregard For the Rights of Others?

Postby Administrator » Mon Oct 03, 2005 7:43 pm

Reckless disregard of the truth is not measured by whether a reasonably prudent person would have published or would have investigated before publishing but means that the defendant in fact entertained serious doubts as to the truth of the communication. Furgason v. Clausen, 785 P.2d 242, 248 [N.M. Ct. App. 1989].
