Credit Rating Damage is Property Damage and Tort-Based

In Louisiana, a claim for damages sustained to a person’s credit rating is tort-based, under La. C.C. article 2315. Rusher v. Winningham Nissan Volvo, 550 So.2d 784 [La. App. 2d Cir. 1989]; Patterson v. Livingston Bank, 509 So.2d 6 [La. App. 1st Cir. 1987] [effect on credit rating; inability to Christmas shop; efforts and expenses of filling out affidavits; number of letters and repeated phone calls to defendants. These are all actionable tort-based damages].
