Jury Trail?

Postby HelpMe2006 » Thu Mar 02, 2006 10:07 pm

Can you request a jury trial in FCRA and FDCPA cases?

Can you request a jury trial for a automatic stay and discharge violation in a BK case?

Sibley v. Fulton Dekalb, 677 F.2d 830 (11th Cir. 1982) exact issue decided under the FDCPA.

Arrows v Kobs, 7th Cir. held there was a right to jury trial under FDCPA.

There is a decision from a federal court in Kansas holding there is a right to a jury trial under the FCRA. I think it is reported on Westlaw - the name of the case is Cole v American Family Insurance. There is also a published 12(b)(6) in that case, and maybe you can get the jury trial ruling from the case history menu.
