MATTER MUST BE WITHIN SCOPE OF AGREEMENT TO ARBITRATE


To determine whether the parties have agreed to arbitrate the dispute, a court must first determine whether there is a valid agreement to arbitrate between the parties and then determine whether the parties' dispute falls within the scope of the arbitration agreement. Id.
