ONYX ACCEPTANCE CORPORATION

PLAINTIFF'S FIRST SET OF
REQUESTS FOR ADMISSIONS TO DEFENDANT

Plaintiff, pursuant to Rule 36 of the Federal Rules of Civil
Procedure, requests that defendant, Equifax Information Services,
LLC [“Equifax”], within thirty (30) days after service of these
requests, make the following admissions for the purpose of this
action:
REQUEST FOR ADMISSION NO. 1:
Admit that Onyx Acceptance Corporation has been a
subscriber and furnisher of credit information to Equifax since
March 1, 2001.
RESPONSE:

REQUEST FOR ADMISSION NO. 2:
Admit that Onyx Acceptance Corporation was assigned Equifax
subscriber/member number 180FA03474.
RESPONSE:

REQUEST FOR ADMISSION NO. 3:
Admit that Onyx Acceptance Corporation reported to Equifax
account information bearing the personal identifier[s] of
plaintiff.
RESPONSE:

REQUEST FOR ADMISSION NO. 4:
Admit that Onyx Acceptance Corporation reported to Equifax
that plaintiff was a co-maker of account number 668004637.
RESPONSE:

REQUEST FOR ADMISSION NO. 5:
Admit that Onyx Acceptance Corporation reported to Equifax
that plaintiff was a co-maker of account number 668004637 and
designated association code “5" indicating that plaintiff was a
co-maker of the above referenced account.
RESPONSE:

REQUEST FOR ADMISSION NO. 6:
Admit that Onyx Acceptance Corporation reported to Equifax
that plaintiff was a co-maker of account number 668004637 and
designated association code “5" outputs onto credit reports as
association code “S” meaning “co-maker.”
RESPONSE:

REQUEST FOR ADMISSION NO. 7:
Admit that Onyx Acceptance Corporation reported to Equifax
that account number 668004637 was a charged off account assigned
for collection.
RESPONSE:

REQUEST FOR ADMISSION NO. 8:
Admit that Onyx Acceptance Corporation reported to Equifax
that account number 668004637 was to be assigned an “I9" rating.
RESPONSE:

REQUEST FOR ADMISSION NO. 9:
Admit that an “I9" rating means an Installment account and
“9" is a maximum derogatory status.
RESPONSE:

REQUEST FOR ADMISSION NO. 10:
Admit that Onyx Acceptance Corporation reported to Equifax
that account number 668004637 had a past due balance of $9,935.
RESPONSE:

REQUEST FOR ADMISSION NO. 11:
Admit that Onyx Acceptance Corporation reported to Equifax,
in January, 2002, that plaintiff was a co-maker of account number
668004637.
RESPONSE:

REQUEST FOR ADMISSION NO. 12:
Admit that in January, 2002, plaintiff’s Equifax credit
report contained a single derogatory reference, that being the
reporting of account number 668004637 by Onyx Acceptance
Corporation.
RESPONSE:
