Lewis v. Ohio Prof. Elec. Network, LLC, 190 F.Supp.2d 1049 [U.S.D.C. E.D. Ohio 2002]. As noted in Northrup v. Hoffman of Simsbury, 134 F.3d [2d Cir. 1997], the term “user” includes the end user even if an intermediary “user”/”reseller” is involved. In sum, nothing prevents an entity from being all 3: reseller, consumer reporting agency and even a user.
Order in the Matter of First American Real Estate Solutions, LLC, Docket No. C-3849; Donald Clark, FTC Informal Staff Op. Letter, “Meltzer Letter,” 7/23/99, Wilson v. Rental Research Servs., Inc., 165 F.3d 642 (8th Cir. 1999) [Finding Rental Research Services, Inc., is a "reseller" and a "consumer reporting agency" under the FCRA].
