Wife has Standing to Sue

Who has the right to bring FCRA and related claims for credit reporting abuses? What if the plaintiff dies? Can a spouse join in the suit for damages?

Rosko v. Trans Union CASE NO. 04CV710 (N.D. Ohio 2005)

Trans Union summary judgment denied as to standing of Patricia Rosko. Although no derogatory information reported about Patricia, merging of Husband's report with his bankrupt father caused Patricia inability to use joint JcPenny's credit card and jointly turned down for a zero percent interest car loan. This affected Patricia's individual credit worthiness as in the Williams v. Equifax, 892 F.Supp. 951 (E.D. Mich 1995). Email if you would like full opinion.
