NEVER AGREE TO WAIVE FUTURE CLAIMS

Postby Administrator » Sun Dec 04, 2005 11:24 am

Brennan's Inc. v. Dickie Brennan & Co. Inc.,
376 F.3d 356, 71 U.S.P.Q.2d 1400, 5th Cir.(La.), Jun 28, 2004

Louisiana law provides that waivers of the right to bring future claims must be clear and are narrowly construed. See Young v. Equifax Credit Info. Servs., 294 F.3d 631, 637 (5th Cir.2002); Brown v. Drillers, Inc., 630 So.2d 741, 752-54 (La.1994).
