I hope it is ok to post this here I was not to sure where to put it.
I have had 3 Chase credit cards for a few years now. The balances of these cards were low till the economy kicked me in a bad place and I leaned on them...
I thought my wife was paying the bills on time even though we were paying minimum payments the hope was things would bounce back a bit and sales would improve.
I am home Saturday and an old man comes to my front door and says " I have a piece of your mail someone must have left at my house. I read it and it is a Judgement complaint so I was served. I was literally in shock, I thought we were paying everything... maybe a month or two where we hit 30 days but nothing we couldn't bounce back from. I check my accounts online and the two accounts in my name say they are ok but I have payments due Dec 26th and Jan 3rd. I then check my wifes account and look for the last payment... the last payment she made was Sept 9th, I look back at the other accounts and find out what happened . She paid one of my accounts twice so technically she was 90 days past due. My wife inst named anywhere on the Judgement letter by the way and one of the cards was in her name only.
At this point I thought I had it figured out and would be able to bring the accounts current $1,600 and go on my merry way. Well I call the legal department of Chase today and got a whole different story. They say we were 7 months late on one card, which was my wifes!!! I told the woman that I see a payment of $200 that was posted on Sept 9th. She proceeds to tell me that we haven't made a payment since July because although we sent money in they didn't meet the minimum payment requirements so that is considered a NON payment. Now we sent in $200 and I guess with the late fees the min payment went up to $225 so for $25 they consider us not paying at ALL!
I then asked the woman why I was never notified or called about this problem cause I would have made sure I rectified the problem. She tells me they have called me at home during the day and on my wifes cell phone. I verified the numbers and they were correct... I said we have never had a message from Chase in any way... She tells me "we don't leave messages during the day!" I said well we work during the day have you ever called us at night? Her answer was "no".. she then proceeds to give me a lecture on checking caller ID and how she would know if someone called her..... I then asked about a paper statement. she said "we stopped sending you those as soon as it hit this department in October", I asked why, she didn't have an answer other then we would have sent you a letter demanding payment. I did not receive any letter at all!!!!!! I know Ignorance is not a valid excuse or argument but if I log on to my Chase accounts and everything looks just fine, how the hell am I supposed to know there is a problem????
They want me to make a payment of $1600 then put me on a payment plan of $400 for 4 years. I do not know if I should or how to answer the Judgement in the Supreme court but they say if I make the payment plan with them they will stop the judgement for now but hold it open in case I do not pay. A public record will be placed on my credit report. Should I take the payment plan?
Any and all advice would be appreciated... I am sorry for the ramble I am just very frustrated right now. I am not trying to run away from anything I owe!
