FACTA: Furnishers Must Cease Reporting ID Theft Related Info

Postby Administrator » Sun Oct 02, 2005 7:22 pm

Furnishers must cease furnishing identity-theft-related information.

As noted above, agencies must block information that a consumer properly identifies as resulting from identity theft and must notify the furnisher of the false information of the block. In turn, the FCRA now requires furnishers who have received such a notice to have reasonable procedures to prevent them from refurnishing the information. The consumer can also trigger that responsibility by notifying the furnisher directly that the furnisher has furnished fraudulent information. However, it appears that a private right of enforcement of these provisions against furnishers by consumers is not authorized under this law. States are preempted from regulating the subject matter of the provisions.
