In this civil case the plaintiffs Richard Rylewicz, Thomas Cummings and Barbara Cummings jointly allege that McDonald's Corporation and others violated the racketeering, civil rights and fair credit reporting statutes as well as committed breach of contract. The basis of the plaintiffs' allegations is an investigation conducted by the defendants subsequent to the jury award of $52 million in the case Central Ice Cream Co. v. McDonald's Corp., 77 L 22117 (Circuit Court of Cook County January 20, 1984). During the Central Ice Cream litigation, a bankruptcy proceeding regarding Central Ice Cream was pending in the United States Bankruptcy Court for the Northern District of Illinois. At the times relevant to the plaintiffs' amended complaint, Thomas Cummings was the President of Central Ice Cream and his wife, Barbara Cummings, owned a substantial number of shares of Central Ice Cream stock. The plaintiffs allege that while post-trial motions were pending in the Central Ice Cream litigation, the defendants conducted a broad investigation designed to intimidate Thomas Cummings into supporting a settlement of the Central Ice Cream judgment in the bankruptcy proceeding. Discovery in this case has been proceeding at a tortuously slow pace. Since the filing of the amended complaint on June 2, 1986, this court has denied a contested motion by the plaintiffs for expedited discovery and contested motions by the defendants for a stay of discovery until a ruling on pending motions to dismiss and for a protective order relating to the defendants' joint defense. Consistent with the generally quarrelsome nature of this case, the parties again are before this court on discovery-related motions.
