FCRA and Fees.

The FCRA allows you to seek your attorney's fees from the parties responsible for reporting errors on your credit report. So in many cases, attorneys handling these claims may represent you on a contingency fee basis, where you pay no attorney's fee unless there is a recovery. You should discuss the fee arrangement with any attorney that you consider retaining for your claims to find out what fee he or she will charge to represent you.

Documents Are Important.

To evaluate the credit reporting mistake made on your report it's usually important to look at documents, especially the most recent copy of your credit report with the credit reporting errors. Changes to the Fair Credit Reporting Act require major credit reporting bureaus (Equifax, Experian and Trans Union) to provide you a free credit report every 12 months. Try online at https://www.annualcreditreport.com. If that doesn't work (unfortunately a frequent occurrence) you can request it by mail using a form from the same site (also available under "links" on this site).

Even better, any creditor can provide you with a copy of a credit report that was used to take adverse action (e.g. application declined or higher interest rate) regarding your credit. It can be difficult to get the creditor to provide what he is allowed to under law. 15 U.S.C. 1681e(c).

A consumer reporting agency may not prohibit a company that pulled your credit report from providing you a copy if that company took "adverse action" based in whole or part on information from the credit report.
